TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern all bookings, participation, and engagement in surf lessons, programs, and related activities (“Services”) provided by Po‘okela Surf School (“Company,” “we,” “us,” or “our”). By booking or participating in any lesson, the client (“Participant,” “you,” or “your”) agrees to be bound by these Terms.

1. Booking & Payment

1.1 All lesson reservations require full payment at the time of booking.
1.2 Lesson dates, times, and instructor assignments are confirmed only upon receipt of payment.
1.3 The Company reserves the right to refuse or cancel any booking at its discretion, with a full refund provided if cancellation originates from the Company.

2. Refund Eligibility

2.1 Participants may request a full refund within 24 hours of the original booking time (“Refund Window”).
2.2 After the Refund Window has passed, all payments are non-refundable, unless otherwise stated herein.
2.3 Refunds will not be issued for Participant cancellations, late arrivals, or no-shows outside of the Refund Window.

3. Cancellations & Changes by Participant

3.1 Participants may cancel or reschedule a lesson more than 24 hours prior to the scheduled lesson start time, subject to availability.
3.2 Cancellations or rescheduling requests made within 24 hours of the scheduled start time are not permitted and will be treated as a forfeiture of the lesson without refund.
3.3 Failure to appear at the scheduled time, or arriving more than 15 minutes late without notice, constitutes a no-show, resulting in the loss of the lesson without refund or rescheduling.

4. Changes or Cancellations by the Company

4.1 The Company may modify, postpone, or cancel lessons due to hazardous weather, unsafe ocean conditions, instructor illness, or any circumstance deemed to pose a safety risk.
4.2 In the event the Company cancels a lesson, Participants will be offered either:
(a) a full refund, or
(b) a complimentary rescheduling of the lesson.
4.3 The Company is not liable for any travel, accommodation, or incidental expenses incurred due to such changes.

5. Participant Responsibilities

5.1 Participants must be physically capable of swimming and safely participating in ocean-based activities.
5.2 Participants agree to follow all instructions provided by instructors and staff at all times. Failure to comply may result in immediate removal from the lesson without refund.
5.3 Participants must disclose any medical conditions, injuries, or limitations that may affect their ability to participate safely.
5.4 The Company is not responsible for loss, damage, or theft of personal items brought to the lesson.

6. Assumption of Risk

6.1 Surfing and ocean-related activities involve inherent risks, including but not limited to physical injury, equipment-related hazards, marine life encounters, and changing ocean conditions.
6.2 By booking or participating in any lesson, Participants acknowledge and voluntarily accept all such risks.
6.3 The Company, its owners, employees, and instructors shall not be held liable for injuries, damages, or losses arising from participation, except where prohibited by law.

7. Media Release

7.1 Lessons may be photographed or recorded for safety, instructional, or promotional purposes.
7.2 By participating, Participants grant the Company permission to use photographs or video footage for marketing or promotional use, unless a written request is submitted declining such use prior to the lesson.

8. Privacy & Data Handling

8.1 Participant information is collected solely for booking, communication, and operational purposes.
8.2 Payment information is processed through secure third-party providers; the Company does not store credit card numbers.
8.3 Personal information will not be sold or disclosed except as required by law.

9. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Hawai‘i. Any disputes arising from these Terms shall be resolved in courts located within the State of Hawai‘i.

10. Acknowledgment

By submitting payment or participating in any Service, the Participant acknowledges that they have read, understood, and agreed to these Terms & Conditions.
